The rule that protects your certificate

There is a rule in B-BBEE verification that surprises businesses when they first encounter it: the agency that verifies your B-BBEE status is not allowed to advise you on how to improve it.

At first that can sound unhelpful. You might reasonably ask why the experts who understand the scorecard best won’t help you do better against it. The answer is the entire reason a B-BBEE certificate means anything at all, and this page explains it — because understanding this rule is the most important thing a business can know when choosing who to appoint.

What the rule actually is

An accredited verification agency operates under a requirement of impartiality, governed by regulation R47-03 and by each agency’s own accreditation conditions. In plain terms: a verification agency may not provide consulting services to a business it verifies. It cannot advise you on how to structure your ownership, improve your scorecard, or address weaknesses, and then also be the independent party that verifies the result.

If an agency does cross that line, the consequence is serious. The independence of its verification is compromised, and it triggers a cooling-off period during which it cannot verify that business at all.

Why the rule exists: the conflict of interest

Consider what verification is for. When a corporate procurement team, a tender board or a customer looks at your B-BBEE certificate, they are relying on it as an independent, trustworthy statement of fact. The certificate’s whole value is that a neutral, accredited third party examined the evidence and confirmed the result.

Now imagine the agency that issued that certificate had also been paid to help you achieve the score. The neutrality is gone. The agency is now, in effect, marking its own homework — verifying an outcome it was hired to produce. Its certificate can no longer be trusted as independent, because it isn’t.

That is the conflict of interest the rule prevents. The separation between advising and verifying is what keeps a certificate credible. Remove it, and the certificate becomes a document a business paid to have produced in its own favour, which is worth very little to the people relying on it.

Why this makes your certificate stronger

Here is the part that turns the rule from a limitation into an advantage. Because an accredited agency is prohibited from advising you, its verification of your business is genuinely independent. When your certificate says Level 4, everyone who relies on it knows that number was reached by a neutral party with no stake in the outcome.

A certificate from a genuinely independent agency holds up. It holds up in a tender adjudication, in a corporate supplier-development review, in a B-BBEE Commission enquiry. That durability is precisely what you are buying when you engage an accredited verifier: not a favour, but an unimpeachable result.

The questions to ask any agency before you appoint it

Whether or not you appoint AQRate, these are the questions worth asking any B-BBEE verification provider:

Are you SANAS-accredited? Accreditation by the South African National Accreditation System is the baseline. It means the agency’s competence, methodology and impartiality have themselves been audited against a national standard. You can verify an agency’s accreditation status directly with SANAS.

Do you also sell consulting on B-BBEE? If a provider offers both to advise you on your scorecard and to verify it, that is a structural conflict. A genuinely independent verifier does not sell you the advice and the verification.

Will I contract and pay you directly? You should contract the verification agency directly, not through an intermediary who sits between you and your verifier. A direct relationship is part of what keeps the verification independent.

Who signs off my result? In an accredited agency, the final result is approved by an independent Verification Manager, separate from the analyst who did the work. That separation of duties is a core control.

If a provider’s answers to those questions are anything other than clean, the certificate they issue may not hold up when it matters.

If you need advice on your B-BBEE strategy, there are consultants who provide it, and that is a legitimate service. But the party that gives you that advice cannot also be the party that independently verifies the result. Keep those two roles separate, and your certificate is worth what it should be.
